Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Haven Springs, LLC (“we”, “us”, “our”) and govern your use of TurboMind.AI (the “Service”). By using the Service, with or without an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms. If you use the Service for an organization, you confirm you are authorized to accept these Terms on its behalf.

You are responsible for keeping access to your email account and sign-in links secure, and for all activity under your account. Tell us promptly at admin@archangel.design if you believe your account has been used without your permission.

You keep ownership of everything you record, type, upload or create in the Service (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, transcribe, transform and display Your Content only as needed to operate, secure and improve the Service and to share it with the people you choose.

You confirm you have the rights needed to submit Your Content, and that it does not violate the law or anyone else’s rights. You are responsible for backing up anything important.

Many places, including California, require the consent of everyone in a conversation before it is recorded. You are solely responsible for telling the people you record and getting any consent the law requires before using the Service to record or transcribe them.

The Service uses artificial intelligence to transcribe, organize, prioritize and translate. AI output may be inaccurate, incomplete, misattributed to the wrong speaker, or otherwise wrong. Review it before relying on it. The Service is not a substitute for professional medical, legal, financial or other advice.

When you share a mind, assign a task or send a calendar invite, the people you add can see and contribute to that mind, and we will send them emails on your behalf. Only add people you have a legitimate reason to contact. You are responsible for what you share and with whom.

You agree not to:

• break the law, or infringe or misappropriate anyone’s intellectual property, privacy or other rights;
• upload content that is unlawful, harassing, hateful, sexually exploitative of minors, or that contains malware;
• send spam or unsolicited invitations through the Service;
• try to access other people’s minds or accounts without permission, or probe, disrupt or overload the Service;
• circumvent usage limits, or scrape, copy or resell the Service;
• reverse engineer the Service, except where the law allows it;
• use the Service to build a competing product.

The Service, including its software, design, logo and branding, belongs to us and our licensors and is protected by law. We grant you a limited, revocable, non-transferable license to use it under these Terms. We may change, suspend or discontinue any part of the Service at any time, and may set or change usage limits.

If you send us feedback or ideas, we may use them without any obligation to you. The Service relies on third-party services (such as sign-in, calendar and AI providers) whose own terms may also apply.

You may stop using the Service at any time and ask us to delete your account at admin@archangel.design. We may suspend or end your access if you break these Terms or if we need to in order to protect the Service, other users or us. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnity and disputes) will survive.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Service will be uninterrupted, secure or error-free, or that content will not be lost.

To the fullest extent permitted by law, Haven Springs, LLC and its members, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or business opportunity, arising from or related to the Service or these Terms, even if advised of the possibility of such damages.

Our total liability for all claims arising from or related to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or 100 US dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify and hold harmless Haven Springs, LLC and its members, officers and employees from any claims, losses and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, your recording of others, or your breach of these Terms or the law.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you and we consent to their jurisdiction. Before filing a claim, please contact us at admin@archangel.design so we can try to resolve it informally.

We may update these Terms. When we do, we will change the effective date above, and for significant changes we will give notice in the Service or by email. Continuing to use the Service after changes take effect means you accept them.

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a merger, acquisition or sale of assets.
